These terms apply when you use Avrati, in the app or at avrati.com. By creating an account or using Avrati, you agree to them. Please read them together with our Privacy Policy.
Avrati is a brand of Anellie LLC, a Delaware company in the United States ("Avrati", "we", "us"), which runs the app and the avrati.com website. The pieces you order are made, invoiced and shipped by our subsidiary in Brazil.
You must be 18 or older to use Avrati. Accounts are created by invitation. You can invite people through Avrati's invitation feature, but you may not pass your account or your access on to someone else.
You sign in with your email or your Google account. Keep access to them secure, because anyone who can read your email can sign in as you. You are responsible for what happens in your account, and you should tell us right away if you think someone else is using it.
Avrati is a jewelry brand: we design and make pieces. With Avrati Studio, in the app and at avrati.com, you create jewelry designs with artificial intelligence and develop a design with us into a piece made for you.
Designs and images generated on Avrati are visual concepts: proportions, stones, colors and details can change when a piece is actually made, and an image is not an offer to make that exact piece.
Pieces from our collections and other purchases follow the terms shown when you buy them.
We may change, improve or stop features at any time.
You keep the rights to the descriptions, photos and comments you add to Avrati. You give us a worldwide, non exclusive license to host, copy, process and show that content as needed to run Avrati for you, including sending it to the providers that generate designs, and to show it to the people you choose to share with. This license ends when you delete the content or your account, except for what we need to keep, such as comments on other people's designs and order records.
You confirm that you have the right to use what you add, and that the people in your photos agreed to it.
We do not use your content to train artificial intelligence models without your consent, and our AI providers may not use it to train theirs.
As between you and Avrati, the designs generated on Avrati Studio, and the work we do to develop them into pieces, belong to Avrati, to the extent the law grants rights in them. You keep the rights to what you add, as described above.
We give you a personal, non-exclusive and non-transferable license to use the designs generated on Avrati Studio for personal purposes. You may:
The pieces in our collections and their designs, including when customized for you, belong to Avrati.
The piece you buy is yours, but its design is not. Without our prior written agreement, you may not copy the designs, have pieces made from them elsewhere, or sell, license or otherwise exploit the images or designs commercially, whether by you or by anyone else. This applies to the specific designs created on Avrati, not to common or classic jewelry forms, which anyone may use.
For any commercial use, write to contact@avrati.com first.
Avrati, its software, brand, visual identity and the content we publish belong to us or to our licensors. Each design is created for you, but AI can arrive at results that resemble existing pieces, so we cannot guarantee that a design is 100% unique in every case.
You agree not to:
We may remove content or suspend accounts that break these rules, and take the legal action available to us.
You can share your designs with other people, who see what you choose to show and your name, and can interact with it if they have an Avrati account. You control what you share and can stop sharing at any time.
You can delete your own comments, and whoever shares their designs can hide comments on them and remove people. We have zero tolerance for objectionable content and abusive behavior: you can report a comment from its menu, we review reports within 24 hours, remove content that breaks these terms and may suspend the accounts that wrote it.
Avrati makes the pieces. When you want a design made, we first develop it with you as a custom project, then produce the piece. Each order shows its price, materials, payment terms and delivery estimate before you pay, and those details apply to that order. Payments are processed by our payment providers.
You can withdraw from an order as the consumer law where you live allows. For pieces from our collections bought online in Brazil, you can withdraw within 7 days of receiving them, as the Consumer Defense Code provides. Pieces developed on Avrati Studio are made to order and only go into production after you approve the project; each order states its cancellation terms before you pay.
Every piece comes with a certificate of authenticity and a warranty certificate. That warranty is in addition to the warranties the law gives you and never reduces them. When we confirm in the project that a piece can be exclusive, we also issue a certificate of exclusivity: only the person who created the project, and the people they authorize in it, can order that piece from Avrati. Pieces based on common or classic forms, such as a plain wedding band, a traditional solitaire or a widely used symbol, are not exclusive and do not receive one, since we and other jewelers make them regularly. Exclusivity applies to the piece described in its certificate and does not transfer its design, which remains Avrati's; a design generated on Avrati is not exclusive by itself.
We may show the pieces we make, and the designs they came from, on our website, social media and other channels. We do not show your name, photos of you or of other people you add without your permission.
Nothing in these terms limits the rights you have under consumer protection law, including the Brazilian Consumer Defense Code.
You can delete your account at any time in the app or at avrati.com. We may suspend or close an account that breaks these terms, after telling you when the law requires it. Deleting or closing an account does not cancel your orders: they continue through delivery, and each order keeps the details it needs, as the law requires.
Avrati is provided as it is and as available. AI generated results can be inaccurate or unexpected, and we do not guarantee that Avrati will always be available or free of errors.
To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for the use of Avrati is limited to the amount you paid us in the 12 months before the claim. These limits do not apply where the law does not allow them, including to the rights of consumers.
We may update these terms. When the changes are significant, we will tell you in the app or by email before they take effect. Changes required by law, or urgent for security, may take effect immediately, and we will tell you as soon as possible. If you keep using Avrati after that, the new terms apply.
These terms are governed by the laws of the State of Delaware, United States. If you are a consumer in Brazil, Brazilian law applies and you can bring claims in the courts where you live. Consumers elsewhere also keep the mandatory protections of the law where they live.
